There is an active and unprecedented lawsuit, Castro V Trump, that is before the US District court involving Mr. John Anthony Castro, Plaintiff, and US 2024 Presidential Candidate who is suing Former President Donald J. Trump on the basis that Trump provided comfort to the January 6th insurrectionists which is a violation of section 3 of the 14th amendment. The case if successful will bar Mr. Trump from being running in the 2024 Presidential elections. In part 1 we provided background to the case and discussed Trump’s motion to dismiss and Castro’s efforts to recuse Judge Aileen Cannon who is the presiding Judge and is obstructing the suit and seem to be a Trump surrogate who was appointed by Trump and has been cited for interfering in a previous case involving Trump.
We learned in part 2 that the recusal is before the US District court and a decision is pending. Moreover, John also discussed Donald Trump’s arraignment and whether his previous suit against the (Federal Elections Commission) FEC helped this current indictment against Donald Trump who violated campaign financing laws to pay hush money through his attorney Michael Cohen over an affair he had in 2010. Mr. Castro explained how the parties are working together to hold trump accountable. He explained that it will take 6 – 9 months before the case goes before trial, as it may include pretrial and exploring discovery of evidence so that the indictment trial may not be until 2025 after the US Presidential elections. Mr. Castro indicated that by next week Friday there should be a ruling on Trump’s motion to dismiss. He stated that there may be a good chance that it is dismissed if Judge Cannon is not recused before then. However, he stated that dismissing the case may put her in a difficult position given his case against her to be recused on the basis of bias.
Therefore, Judge’s Cannon has to provide a strong argument to dismiss which will be scrutinized given the recusal case. However, if the case is dismissed, John stated that there is a plan to take it all the way to the supreme court, which is the ultimate goal. Furthermore, if Trump’s motion was denied and Castro were to succeed, then Trump may also take it to the Supreme court and according to Castro, he sees a 50-40 decision in his favor.
