The Neoliberal Round New Podcast series: This is Part 1 of a Series on the Castro V. Trump Case with main plaintiff, John Anthony Castro, US 2024 Republican Presidential Candidate, hosted by Rev. Renaldo C. McKenzie of The Neoliberal Round. The Castro V Trump case started on January 25th, 2023 when Mr. Castro filed a lawsuit in the US District Court Southern District of Florida against Former President Donald J. Trump. Castro’s lawyers delivered the suit to Mr. Trump at his Mar-a-Lago residence in Florida. This suit by Mr. Castro follows another suit that he had filed against the FEC on January 25th, 2022 that the FEC should not accept Mr. Trump’s candidacy on the basis that he violated Section 3 of the 14th Amendment of the US constitution. According to the amendment, no person seeking elected office who had formerly held such an office may be eligible to run for said office unless congress removes this disqualification. Mr. Castro’s lawsuit claims that because Trump provided comfort to the January 6th insurrectionists, he should not be able to run. The case was dismissed by the courts concluding that the FEC cannot disqualify a candidate but can only regulate campaign financing. We explore that briefly before we introduce Mr. Castro. Mr. Castro provided an update on the case regarding the timeline and expectations. According to Mr. Castro, who provided court documents to the effect, Mr. Trump filed a motion on February 16th to dismiss the suit on the following basis: 1. The plaintiff lack standing, 2. If he does not lack standing, he lacks “ripeness”, 3. The Court lacks jurisdiction, 4. The plaintiff has not distinguished himself from the public, 5. The plaintiff is not a Bonafide candidate, as he has not registered in all US states as a candidate. Mr. Castro responded to the suit citing precedence and evidence of his candidacy. Mr. Castro has also asked for an emergency stay on the decision to dismiss brought forth by Trump in order that the Writ of Mandamus to remove Judge Cannon is heard before the 11th circuit.
Mr. Castro explored the way the case may end up at the US Supreme court and provided a timeline, suggesting that the justices may take up the case in October of 2023 and that the next ruling on the case may come in as early as two weeks concerning the recusal of Judge Cannon who was appointed by Trump and seems to demonstrate partiality. Mr. Castro elaborates on this in Part 1 of the series and explain the poor coverage which he states is not a concern at this time.
